MuseClass Primary is an online platform (“Services” or “MuseClass Primary”), which helps our Customers (“you” or “Customers”) deliver singing and learning resources to their Students. MuseClass Primary is owned and operated by Hal Leonard Europe Limited (“Hal Leonard”, “we” or “us”), located at Acre House, 11/15 William Road, London, United Kingdom, NW1 3ER.
Definitions
Personal Data means any information relating to an identified or identifiable natural person (a data subject),
and includes "personally identifiable information". An "identifiable natural person" is one who can be identified, directly or
indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online
identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity
of that natural person.
Customers include both teachers who represent schools and independent teachers/freelancers who have signed up for our Service and act as independent controllers.
School means any public or private organisation, institution or service involved in the provision or support of education or training in the United Kingdom.

Information we collect about you
We may collect the following information:
- your name, e-mail address and phone number, (including on- line identifiers, IP addresses and device information);
- your address/shipping address (including street, city, county and post code);
- if you buy something from us, your billing/payment information (including cardholder name, daytime phone, billing address, card type, last 4-digits of the credit card number, and/or PayPal transaction ID - All credit card information is processed by our PCI compliant payment processor;
- products and services purchased from us and use of promotion codes;
- your password, if you register with us;
- if you are buying in your capacity as an employee of a business or an educational establishment (such as a school) then we may collect, your job title, company/employer name and work contact details including phone number and address;
- if you are a music teacher or other music professional, we may collect details of the type of music you teach or your professional role, and your membership of any teaching association or other organization for music professionals;
- information about your visit, including your online browsing history on our site, which may include products or services you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page;
- your location;
- communications, information and feedback you send to us;

Student Data Ownership
All Student Data remains the property of and is solely owned, and thereby controlled, by our Customers. We may only use student personal data, for example technical information, for the purposes of providing the products and services that our Customers have contracted with us to provide and we will process student personal data according to instructions and the terms of our contract with our users. Student personal data will not be used for targeted advertising by us or any of its affiliates or third parties.
Personal Data processing roles
MuseClass Primary provides learning and registration products and services to end-users as a “data processor.” The main responsibility of what is known as a “data controller” lies with the School or Customers. This also means that the school or school district's own privacy statement governs the use of student personal information. MuseClass Primary's users determine what information we collect through the MuseClass Primary products and services and how it is used, and we process that information according to our user's instructions and the terms of our contract with our user.
Disclosures
We may share Personal Data with selected third parties including:
- entities that assist us in providing customer service and technical support to users in relation to the Service;
- independent contractors, vendors, and suppliers we engage to provide specific services and products related to our website and our services, including cloud service providers, including the entity that hosts the software, for the purposes of storage and such hosting;
- if we are under a duty to disclose or share Personal Data in order to: comply with any legal obligation, including without limitation lawful requests by public authorities such as to meet national security or law enforcement requirements, and including with regulators and other authorities who require reporting of processing activities in certain circumstances; or to enforce or apply our standard terms and conditions of business and other agreements; or to protect the rights, property, or safety of Hal Leonard, our clients, or others. - if we become involved in a merger, acquisition, or any form of sale or transfer of some or all of its assets, your information will be transferred to the acquiring entity. In such a situation, you will be provided with notice that a transfer of your information is imminent, and you will be given an opportunity to opt-out of the transfer of your information.
Data storage, retention and deletion
- We will only retain Customer personal data for as long as necessary to fulfil the purposes for which we collected your personal data. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of that personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. If by law we are required to retain any information about our customers or their interactions with us, we will retain your personal data insofar as required to comply with such law.
- Customers acting as a data controller defines the retention period for Student Personal Data and could request Personal Data transfer or deletion if needed.
- We may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
Sharing and transfer your personal data
- All information you provide to us is stored on secure servers. These may be located anywhere in the world, including the USA.
- Some of our external third parties to whom we transfer your personal data as described above are based outside the UK and/or the European Economic Area (EEA).
- If we transfer your personal data outside of the UK or the EEA we will ensure that we do that in accordance with data protection laws, which may involve us putting in place additional contractual arrangements to provide the right level of protection for any personal data that is transferred.
